Industrial Chemicals (Notification and Assessment) Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Industrial Chemicals (Notification and Assessment) Act 1989.

1.   Amendment

1.1   The Industrial Chemicals (Notification and Assessment) Regulations are amended as set out in these Regulations.

[Note: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 13 (Fees)

2.1   Paragraph 13 (2) (a):

Omit “$6,700;”, substitute “$11,700;”.

2.2   Paragraph 13 (2) (b):

Omit “$5,600;”, substitute “$9,800;”.

2.3   Paragraph 13 (2) (c):

Omit “$2,500.”, substitute “$3,300.”.

2.4   Paragraph 13 (3) (a):

Omit $4,000;”, substitute “$7,200;”.

2.5   Paragraph 13 (3) (b):

Omit “$1,000.”, substitute “$5,800.”.

3.   Regulation 14 (Payment of other fees)

3.1   Omit the regulation, substitute:

When must fees be paid

 “14.(1)Subject to subregulation (2), a fee prescribed under regulation 13 must be paid at the time of lodgement of the application, statement, nomination or notification to which it relates.

 “(2) A fee prescribed by paragraph 13 (2) (a) or 13 (2) (b) must be paid in instalments as follows:

  • (a)

    the applicant must pay a first instalment of $500 when the application is given to the Director; and

  • (b)

    the applicant must pay a second instalment, of an amount that equals the balance of the prescribed fee, before the end of 7 days after the day on which the Director advises the applicant that the application and the accompanying notification statement are complete for the purpose of assessment.”.

4.   Schedule 2 (Fees)

4.1   Omit items 3B and 4.

4.2   The Schedule is further amended in accordance with the following table:
