Industrial Chemicals (Notification and Assessment) Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under section 4 of the Acts Interpretation Act 1901, make the following Regulations under the Industrial Chemicals (Notification and Assessment) Act 1989.

1.   Commencement

1.1   These Regulations commence on 7 August 1997.

2.   Amendment

2.1   The Industrial Chemicals (Notification and Assessment) Regulations are amended as set out in these Regulations.

3.   New regulation 6AA

3.1   After regulation 6, insert:

Prescribed period—transfer of industrial chemical from non‑confidential section to confidential section (subsection 18A (1) of the Act)

 “6AA.   For the purposes of subsection 18A (1) of the Act, the prescribed period is the period of 56 days commencing on 7 August 1997.”. 

4.   New regulations 9A and 9B

4.1   After regulation 9, insert:

Prescribed information—summary report of final assessment (paragraph 60F (5) (d) of the Act)

 “9A. For the purposes of paragraph 60F (5) (d), a summary report of a final assessment must contain the following:

• (a)

  a statement of the type of assessment carried out (that is, whether a full, or preliminary, assessment was carried out);

• (b)

  a concise description of the matters taken into account in preparing the assessment report;

• (c)

  the chemical names of hazardous constituents of the chemical;

• (d)

  a summary of the occupational health and safety, and public health and environmental, matters contained in the assessment report;

• (e)

  the intended use of the chemical;

• (f)

  any recommendations contained in the assessment report in relation to the chemical. 

Prescribed authorities—paragraph 60F (7) (a) of the Act

 “9B. For the purposes of paragraph 60F (7) (a) of the Act:

• (a)

  the following authorities are prescribed for the Commonwealth:

  • (i)

    the Department of the Environment, Sport and Territories; and

  • (ii)

    the Department of Health and Family Services; and

• (b)

  Worksafe Western Australia is prescribed for the State of Western Australia.”.

5.   New regulation 11AAA

5.1   After regulation 11AA, insert:

Urgent handling fee (paragraph 80F (d) of the Act)

 “11AAA. For the purposes of paragraph 80F (d) of the Act, the urgent handling fee is $200.”. 

6.   Regulation 13 (Fees)

6.1   Paragraph 13 (3) (a):

Omit “$7,200;”, substitute “$6,480;”.

6.2   Paragraph 13 (3) (b):

Omit “$5,800.”, substitute “$5,220.”.

7.   Schedule 2 (Fees)

7.1   Item 3:

Omit “600”, substitute “1,500”.

7.2   After item 3A, insert:

“4 Paragraph 110 (1) (caaa) 1,350”.

7.3   The Schedule is further amended in accordance with the following table:
