EEGULATIONS U N D E E T H E INDUSTBIAL BOAED

ORDINANCE 1922-1925.

Pursuant to the powers conferred upon it by the Industrial Board

Ordinance 1922-1925, the Federal Capital Commisaion hpreby makes the following Regulations to come into operation forthwith.

<I 1. These Eegulations may be cited as the Industrial Board Eegu- short title

2. In these Eegulations, unless the contrary intention appears— Definitions,
"candida te" means a candidate for election;
" election " means the nomination by workmen of a person to be

"nominat ion" means the nomination of a candidate;

Dates for 4. (1.) The Returning Officer shall, subject to the concurrence of

(a) fix the last date for the receipt of nominations (in these

Regulations referred to as " nomination d a y " ) ;

(b) fix the date for the taking of the poll (in these Regulations

referred to as " polling day " ) and the hours of polling;

Provided that the date fixed for polling day shall be not less than seven days nor more than fourteen days after nomination. day ; and

(c) appoint such polling places in the Terri tory a.s he deems

necessary.

(2.) The dates and hours fixed and the polling places appointed in pursuance of this regulation shall be notified, at least seven days before nomination day, in one issue of the Gazette and in one issue of a news- paper circulating in the Territory, and copies of the notices so published shall at the same time be posted conspicuously at the office of the Commission, and, as far as practicable, at all works where workmen are engaged.

5. (1.) The secretary of the Commission shall cause to be pre- pared and transmitted to the Returning Officer so as to reach him be- fore noon on nomination day a list (in duplicate) certified by him containing the names of all workmen who on that date are qualified to vote at the election and setting out the occupation of each workman.

(2.) The secretary of the Commission shall cause to be prepared and transmitted to the Returning Officer so as to reach him before 6 p.m. on the day preceding polling day a supplementary lis! (in duplicate), certified by the secretary, containing the names of all workmen who have become qualified to vote, and specifying those persons who have ceased to be workmen, since the list mentioned in the last preceding sub-regulation was prepared.

(3.) The Returning Officer shall strike out from the list trans- mitted to him in pursuance of sub-regulation (1.) of this regulation the names of those persons who are specified in the supplementary list as having ceased to be workmen since the preparation of the list mentioned in that sub-regulation, and the names (specified in the supple- mentary list) of all workmen who have become qualified 1o vote since the preparation of that list shall he deemed to have been added to the list.

(4.) Where elections by all or any Uvo of the classes of workmen specified in sub-sections (8.) , (9.) and (11.) of section 3 of the Ordi- nance are to be held on the same day, the list and supplementary list of any one class shall be prepared separately from the list and supple- mentary list, respectively, of any other class of workmen.

(5.) The list of voters certified and transmitted to the Returning Officer under this regulation (in these Regulations referred to as " the certified list of vo te r s" ) shall be used by the Returning Officer for the purposes of the election.

(6.) Copies of the list transmitted to the Returning Officer in pur- suance of sub-regulation (1.) of this regulation shall be available for inspection by workmen seven days prior to the date of any election and shall be exhibited at Canberra. Eastlake, Westlake, Westridge, and i^folonglo Post Offices.

Nomination?.

6. (1.) Xominations shall be lodged with the Returning Officer, or a person thereto authorized by him, on or after the date of the noti- fication in the Gazette of nomination day and before noon on nomina- tion clay.

(2.) -V nomination shall—

(a) name the candidate for election and shall specify his ad-

dress and occupation; and

(b) be signed by not less than ten workmen qualified to be voters in the election for which the candidate is nominated,

and shall be in accordance with F o r m A. in the Schedule to these
Regulations.

(3.) A nomination shall not be valid unless the candidate has con- sented to the nomination and to act if elected.

(4.) Nominations shall be notified at least three days before poll- ing day in one issue of the Gazette and in one issue of a newspaper circulating in the Territory, and copies of the notices so published shall at the same time be posted conspicuously at the office of the Commis- sion and, as far as practicable, at all works where workmen are en-

(2.) Where a voter claims to vote under the provisions of this regu- lation he shall mark and fold his ballot-paper in the manner prescribed in these Regulations and return it so folded to the Returning Officer.
(3.) The Returning Officer shall thereupon in the presence of the voter and of such scrutineers as are present, and without unfolding the ballot-paper, enclose it in an envelope bearing the declaration of the voter and shall forthwith securely fasten the envelope and deposit it in the ballot-box.
(4.) Upon the opening of the ballot-box the Returning Officer shall, before opening the envelope, examine the declaration of the voter, and, if it is in order and he is satisfied after making such inquiry as may be necessary, that the voter is a person entitled to vote at the election, he shall correct the certified list of voters by adding, thereto the name of the voter and the other particulars relating to the voter specified" in the declaration and remove the ballot-paper from the envelope and place it for further scrutiny among the other ballot-papers unenclosed in envelopes in such a manner that it cannot be identified as the ballot- paper of the voter.
(5.) Where the claim of any person to vote under this regulation
is refused, the Returning Officer shall make a note in writing of the
fact of the claim and the reasons for the refusal thereof, and shall
sign it in the presence of such scrutineers as are present. Any of those
scrutineers may also sign the note.

(6.) The Returning Officer shall place in a sealed packet the en-

velopes from which ballot-papers are removed in pursuance of this regulation, and shall forward the packet to the Commission and it shall be retained by the Commission.

Provided further that the candidate who has received an absolute majority of votes shall be the candidate elected:

Provided also that if on any count two or more candidates have ' an equal number of votes and one of them has to be excluded, or if in the final count two candidates have an equal number of votes, it shall be decided by lot, in such manner as the Returning Officer deter- mines, which candidate shall be excluded or nominated by the workmen, as the case requires.

him at polling places during the polling and at the scrutiny.

(2.) All the proceedings at the scrutiny shall be open to the inspec-

tion of the scrutineers.

14. The certificate of the local representative at Canberra of an organization specified in the Fi rs t or Second Schedule to the Ordinance that a workman is a member of that organization shall, for the purposes of these Regulations, be sufficient proof of the work- man's membership of the organization.

Preservation of 15. The ballot-papers and envelopes used in connexion with an

NOTE.—(a) Here insert the Christian name or names in full, surname, place of residence, and occu-

pation of person nominated.

N.B.— The candidate's consent to the nomination may be on a separate paper and in any form, but

if given on the Nomination Paper in the above form their sufficiency is not to be questioned.

A nomination must be signed by not less than ten persons entitled to vote at the election for which
