(AMENDMENT) ACT.

W a l e s in P a r l i a m e n t assembled, and by the au thor i ty of

t h e same, as follows :—

1 . (1) This A c t may he cited as the " I n d u s t r i a l
Arb i t r a t i on ( A m e n d m e n t ) Act , 1922 ."
(2) The Indus t r i a l Arb i t r a t i on Ac t , 1912, as

amended by subsequen t Acts , is in this Act referred to

as t h e Pr inc ipa l Act .

2 . Section five of the Pr inc ipa l Ac t is amended by

inse r t ing in t he definition of " E m p l o y e r " after t h e
words " employed u n d e r " the words " the Pub l ic

Service Act , 1902, and . "

3 .     Sections 1 3 B and 13c of t he Pr inc ipa l A c t are

repealed.

4 . Subsection one of section twenty- four of the

Pr incipal A c t is a m e n d e d —

(i)   By omitting the proviso to paragraph (a) and

subs t i tu t ing therefor the following new
provisos :—

Provided t h a t no award shall be made for the p a y m e n t of wages or r emunera t ion in excess of ten pounds per week or (where salaries are paid on an annua l basis) any sa lary in excess of five h u n d r e d and t w e n t y -

five pounds per a n n u m :  Provided

Prov ided fu r ther tha t no award shall he made for the

p a y m e n t

of wages or

r e m u n e r a t i o n

of persons occupying manager ia l posit ions unless such persons are exclusively employed by the Railway Commissioners of N e w South Wales, the Met ropo l i t an Mea t I n d u s t r y Board ,

the Sydney H a r b o u r T rus t Commissioners , the
Board of W a t e r Supply a n d Sewerage, t he
M a t e r Conservat ion and I r r iga t ion Commis-
sion, the Board of F i r e Commissioners of N e w

Sou th Wales, or t h e H u n t e r Dis t r ic t Water Supp ly a n d Sewerage Board, or are employees of any city, shire , or mun ic ipa l council ;

(ii)   by omitting all words after the words " con­

ceded to such employees " in p a r a g r a p h (h).
3 . Section 24B of t h e Pr inc ipa l A c t is omi t ted and

t h e following new section is subs t i tu ted therefor :—

24B. Employees who are employed—

(a) upon farms, orchards, vineyards, or agri­
cu l tu ra l or pastoral holdings in connect ion

wi th dai ry ing, poul t ry fa rming or bee fa rming , or the sowing, ra is ing , ha rves t ing or t r ea t ing of grain, fodder, fruit , or other farm produce , or the m a n a g e m e n t , rear ing, or graz ing of horses, ca t t le , sheep, or o ther live stock, or t h e scouring, sor t ing, or pressing of wool or at o ther fa rm or s ta t ion

w o r k ; or
(b) in or in connection with the formation,
t end ing , protect ion, or regenera t ion of

forests ; or

(c) in flower or vegetable market-gardens or
nu r se r i e s ; or
(d) at c lear ing, fencing, t r ench ing , dra in ing , or o therwise p r e p a r i n g land for any of the
abovement ioned purposes ,

shall not be subject to the provisions of this Ac t
o ther t han P a r t s X and X I :

Provided tha t th is section shall not apply to employees in an indus t ry in respect of which an award had been made prior to t he twenty-second day of M a r c h , one t housand nine h u n d r e d and e ighteen.

  1. .     Section twenty-five of the Pr inc ipa l A c t is amended

by omi t t ing the first proviso to subsect ion one a n d
subs t i t u t i ng therefor t he following new proviso :—

Provided tha t the cour t may , in i ts discret ion, order and de te rmine t h a t an award shal l t ake effect f rom such day subsequen t to the lodging or filing of t h e appl icat ion therefor as t h e cour t m a y direct .

7 .     Section twenty-s ix of t h e Pr inc ipa l A c t is omi t ted

and the following new section is subs t i tu ted t he re fo r :—

26. (1) A n y award affecting employees employed unde r the Publ ic Service Act, 1902, which is in force on the first day of October, one thousand nine h u n d r e d and twenty- two , shall con t inue in force only for t h e period specified there in .

(2) A n appl icat ion for an award for em­ ployees employed u n d e r the Pub l ic Service Ac t , 1902, which was pend ing on the first day of October, one thousand n ine hundred and twen ty - two, may be heard and de termined by the court , and an award may be made in respect thereof for any period not la ter t h a n t h e s ix th day of J u l y , one thousand n ine h u n d r e d and twen ty - th ree ,

specified there in .

(3) A n y award to which th is section appl ies shall be subject to the provisions of th is Ac t , inc lud ing provisions re la t ing to the var ia t ion or a m e n d m e n t of awards , b u t no twi th s t and ing any­ t h i n g contained in section twenty-five or twen ty -n ine no such award shall be ex tended beyond or con t inue

in force after the period specified there in .
(4) N o t w i t h s t a n d i n g a n y t h i n g conta ined in

th is Ac t , any award to which th i s section applies shall t a k e effect from such day, w h e t h e r before or subsequen t to the filing of the appl ica t ion therefor,

as t he cour t m a y direct .
8 . The following new section is inser ted after
sect ion s ixty of the P r inc ipa l A c t : —

60A. All awards , orders, proclamat ions or other notif ications, excep t ing rules or regu la t ions required or directed by th is A c t to be publ ished in the Gazet te , may be publ ished ei ther in the Gazet te or

in the N e w Sou th Wales I n d u s t r i a l Gaze t te .

9 . Section seventy-five of t he Pr inc ipa l Act is

amended as follows :—

(i)   By inserting the word " and " between the

words " d e p u t y p r e s i d e n t " a n d " f o u r " in
subsect ion o n e ;

(ii)   by omitting in subsection one the words " and one or more addi t ional Commissioners appoin ted to represent ru ra l indus t r ies " ;

(iii)    by omi t t i ng subsect ion (1A) ;

(iv)    by omi t t i ng in subsect ion four the word " five "

and subs t i t u t i ng therefor the word " t h r e e . "
1 0 . Section seventy-s ix of t h e Pr inc ipa l Act is
a mende d by omi t t i ng t he proviso.
1 1 . Section seventy-n ine of t h e P r inc ipa l Ac t is

omi t ted and the fol lowing new section is subs t i tu ted

therefor :—

79. (1) The Board of Trade shal l a t such t imes as t h e board m a y t h i n k fit, b u t at in te rva ls of no t

less t h a n t h r ee m o n t h s , after publ ic i n q u i r y as to t h e increase or decrease in t h e average cost of l iv ing declare w h a t shal l for t h e purpose of this Act be t h e l iv ing wages for adu l t ma le and adul t female employees in t he S ta te or any defined area thereof.

(2) N o indus t r ia l ag reement shall be entered

in to and no award m a d e for wages lower t h a n such

l iving wages .
(3) I f it is proved to the cou r t—
(a) by the produc t ion of books used in connec­ t ion wi th the ca r ry ing on of an indus t ry by o ther evidence produced or tendered a n d subjec t mu ta t i s m u t a n d i s to the provisions

and res t r ic t ions conta ined in section t h i r t y - four (c) t h a t serious unemploymen t in a n indus t ry has resul ted or will resul t from the opera t ion of an award or indus t r ia l agree­ men t ; or

(b)

that the employees in an industry or the employees of any employer the re in are or m a y become ent i t led to any benefit or pay­ m e n t unde r any profi t -sharing or co-par tner­ ship scheme,

t he

the court upon being1 satisfied that it is in the best interests of the employees so to do, may, either absolutely or upon terms—

(a) refrain from making any award ; or

(b) rescind or cancel any award or industrial agreement; or
(c) exempt from the provisions of an award or industrial agreement any employees who are or may be entitled to any benefit or payment under any profit-sharing or co-partnership scheme and their employer.

1 2 . Section eighty-one of the Principal Act is amended by omitting in subsection one the words " t w o preceding sections" and substituting therefor the words " preceding section."
