AN ACT to amend section sixty-one B of the

Industrial Arbitration Act, 1912-1976.

[Assented to 2nd December, 1976.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

1. (1) This Act may be cited as the Industrial

Section 61B

amended.

2. Section 61B of the principal Act is amended

(a) by repealing subsection (1);

(b)

by deleting the words "on the grounds of conscientious belief" in paragraph (a) of subsection (2);

(c)

by deleting the words "in the manner prescribed" in line one of paragraph (b) of subsection (2) and substituting the words

"in writing";

(d)

by adding after the word "thereof" in line three of paragraph (c) of subsection (2) the passage "and requests the Registrar to pay that amount to such one of the following as that person nominates, namely, the Consolidated Revenue Fund, the Distressed Persons Relief Trust established under the Distressed Persons Relief Trust Act, 1973 or such public charitable or benevolent body or institution as the person specifies" ;

(e)

by deleting the passage ", unless the Registrar is satisfied that the objections of the person on the grounds of conscientious belief are not genuine" in lines twelve, thirteen and fourteen of subsection (2); and

(f)

by adding after the word "Fund" in line two of subsection (4) the passage ", the Distressed Persons Relief Trust or the public charitable or benevolent body or institu- tion, according to the nomination of the person,".
