An Act to amend the Indigenous Education (Supplementary Assistance) Act 1989, and for related purposes

The Parliament of Australia enacts:

1Short title

This Act may be cited as the Indigenous Education (Supplementary Assistance) Amendment Act 1998.

2Commencement

This Act commences on the day on which it receives the Royal Assent.

3Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Funding of education for Indigenous students: minimum percentage of Indigenous students no longer required

Indigenous Education (Supplementary Assistance) Act 1989

Paragraph 10D(1)(c)

Repeal the paragraph, substitute:

  1. (c)

    the number of those students is 20 or more.

Paragraph 10E(1)(c)

Repeal the paragraph, substitute:

  1. (c)

    the number of those students is 5 or more.

Paragraph 10F(1)(c)

Repeal the paragraph, substitute:

  1. (c)

    the number of those students is 20 or more.

At the end of Part 3

Add:

13CCost supplementation

  1. (1)

    The regulations may state, for a period referred to in subsection 13B(4), (5), (6) or (7), a number worked out after considering changes in an Index determined in writing by the Minister for Finance to be an appropriate Index to be used for the variation, in accordance with this section, of the amount stated in that subsection.

  2. (2)

    If a number (the stated number) is stated in regulations made for the purposes of subsection (1), for a period referred to in subsection 13B(4), (5), (6) or (7), the amount set out in that subsection (the stated amount) is taken to be replaced by the amount worked out using the formula:

  3. (3)

    If an amount worked out under subsection (2) is not a multiple of $1,000, the amount is to be rounded to the nearest $1,000 (rounding $500 upwards).

15Regulations

The Governor-General may make regulations prescribing matters:

  1. (a)

    required or permitted by this Act to be prescribed; or

  2. (b)

    necessary or convenient to be prescribed for carrying out or giving effect to this Act.
