Tribunal (Water Services) Order 2004

under the

Independent Pricing and Regulatory Tribunal Act 1992

I, ROBERT JOHN CARR, Premier, in pursuance of section 4 of the Independent
Pricing and Regulatory Tribunal Act 1992, make the following Order.

I certify that the services specified in the following Order are services:

(a)

for which there are no other suppliers to provide competition in the part of the market concerned, and

(b)

for which there is no contestable market by potential suppliers in the short term in that part of the market.

Independent Pricing and Regulatory Tribunal (Water

Services) Order 2004

under the

Independent Pricing and Regulatory Tribunal Act 1992

1      Name of Order

This Order is the Independent Pricing and Regulatory Tribunal (Water
Services) Order 2004.

2      Definitions

In this Order: constituted under the Water Management Act 2000.

SWC means the State Water Corporation constituted under the State
Water Corporation Act 2004.

3      Declaration of government monopoly services

Any service provided by the SWC or WAMC, to the extent to which the service involves:

(a) the making available of water, or

(b)

the making available of the SWC’s or WAMC’s water supply facilities, or

(c)

the supplying of water, whether by means of the WAMC’s or SWC’s water supply facilities or otherwise,

is declared to be a government monopoly service.

4 Repeal of Government Pricing Tribunal (Water Services) Order 1995

The Government Pricing Tribunal (Water Services) Order 1995 is repealed.
