Independent Pricing and Regulatory Tribunal Act 1992

I, Kristina Kerscher Keneally, Premier, in pursuance of section 4 of the Independent

Pricing and Regulatory Tribunal Act 1992, make the following Order.

Explanatory note

The object of this Order is to enable the implementation of a limited number of MyZone ticket fares that might otherwise be subject to an IPART pricing determination. The proposed Order will have effect for a temporary period only.

1      Name of Order

This Order is the Independent Pricing and Regulatory Tribunal
(Passenger Transport Services) Amendment Order 2010.

2 Amendment of Independent Pricing and Regulatory Tribunal (Passenger Transport Services) Order 1998

Insert after clause 3:

4      Exclusion of services from declaration

(1)  The transport passenger services supplied in accordance with any of the following MyZone tickets are also excluded from any declaration under clause 3:

(a)	MyTrain 28-day RailPass (including concession),
(b)	MyTrain 365-day RailPass (including concession),
(c)	MyTrain Child Off-peak Return,
(d)	MyMulti Day Pass.

(2)

Subclause (1) ceases to have effect:

(a)	12 months after the commencement of this clause, or
(b)	on the date on which Schedule 1 to the CityRail Final Determination No 4, 2008 is replaced by a determination of the Tribunal under Part 3 of the Independent Pricing and Regulatory Tribunal Act 1992,

whichever is the later.
