Alteration of other rules of organisation.

[1]        On 2 June 2015 the South Australian Branch of the Independent Education Union of

Australia (the Branch) lodged with the Fair Work Commission (‘the Commission’) a notice

and declaration setting out particulars of an alteration to the South Australian Branch Rules

(‘Branch Rules’).

[2]        The particulars set out an alteration to Rule 12.5 of the Branch Rules.

[3]        The alteration redefines the financial year of the Branch so that it will run from 1

January to 31 December. By its terms the altered Branch Rule would operate from 1 January

2017. When read in conjunction with section 240 of the Fair Work (Registered

Organisations) Act 2009 (the RO Act), the alteration means that the Branch’s current financial

year is from 1 February 2015 until 31 January 2016, the next financial year will run from 1

February 2016 to 31 December 2016, and thereafter each financial year will be from 1

January to 31 December.

[4]        On 26 June 2015, Branch Secretary Glen Seidel, gave consent, under subsection

159(2) of the Fair Work (Registered Organisations) Act 2009, for the Delegate to make

various amendments to the alterations for the purpose of correcting typographical, clerical or

formal errors. Accordingly the following corrections have been made:

In proposed Rule 12.5: To remove the figure 2016 and insert in lieu 2017.

[5] On the information contained in the notice, I am satisfied the alteration has been made

under the rules of the organisation.

[6]        In my opinion, the alteration complies with and is not contrary to the RO Act, the Fair

Work Act 2009, modern awards and enterprise agreements, and is not otherwise contrary to

law. I certify accordingly under subsection 159(1) of the Fair Work (Registered

Organisations) Act 2009.
