Alteration of other rules of organisation.

[1] On 24 October 2013 the Victoria Tasmania Branch of the Independent Education Union of Australia lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to the rules of the Independent Education Union of Australia - Victoria Tasmania Branch.

[2] The particulars set out alterations to rules 8, 13 and 14 and the deletion of rule 24 of the rules of the Independent Education Union of Australia -Victoria Tasmania Branch. The alterations provide for altering the powers of the Branch Conference and Branch Committee of Management, the election of an alternate delegate to Federal Conference and the deletion of transitional rules.

[3] Further information regarding the actions taken to make the alterations was provided

on 12 September 2014. On the information contained in the notice and the further information
provided, I am satisfied the alterations have been made under the rules of the organisation.

[4] I note a statutory declaration of Ms Debra James, General Secretary of the Branch declared on 17 September 2014 lodged on the same date confirms that the Branch Conference were aware of and supported the alteration transferring some of its powers to the Branch Committee of Management.

[5] On 12 September 2014 the General Secretary of the Branch, gave consent, under subsection 159(2) of the Fair Work (Registered Organisations) Act 2009, for the Delegate to make various amendments to the alterations for the purpose of correcting typographical, clerical or formal errors. Accordingly the following corrections have been made:

 In proposed rule 13(a) by inserting the word ‘the’ after the word ‘and’.

[6] In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise

agreements, and are not otherwise contrary to law. I certify accordingly under subsection

159(1) of the Fair Work (Registered Organisations) Act 2009.
