(B2012/1471)

COMMISSIONER SIMPSON

BRISBANE, 13 AUGUST 2012

Application to revoke order made in B2012/1300 as varied by B2012/1459.

[1] On 26 July 2012 I issued an Order, PR526827 (relating to St Joseph’s School (Secondary Campus)) granting applications by the Independent Education Union of Australia (IEUA) for a protected action ballot order affecting The Corporation of the Roman Catholic Dioceses of Toowoomba T/A Toowoomba Catholic Education Office. On 9 August 2012 I issued an Order, PR527611 varying Order PR526827.

[2] On 10 August 2012 an application was made in accordance with s448 by the IEAU to revoke Order PR527611 and PR526827. I am satisfied as required by s448(1) the application has been made before voting in the protected action ballot closes. In accordance with s448(2) I must revoke the Orders and on that basis I do so. A Revocation Order will be issued to give effect to this decision.
