COMMISSIONER CIRKOVIC

MELBOURNE, 27 MARCH 2019

Application for approval of the St Mary's Child Care Centre Teachers' Agreement 2018.

[1] An application has been made for approval of an enterprise agreement known as the St Mary’s Child Care Centre Teachers’ Agreement 2018 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by the Independent Education Union of Australia. The Agreement is a single enterprise agreement.

[2] The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement.

[3] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.

[4] The Independent Education Union of Australia being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.

[5] The Agreement was approved on 27 March 2019 and, in accordance with s.54, will operate from 3 April 2019. The nominal expiry date of the Agreement is 30 June 2020.

CaseChat Overview and Summary

The Independent Education Union of Australia, acting on behalf of teachers employed at St Mary's Child Care Centre, sought approval of the St Mary's Child Care Centre Teachers' Agreement 2018 from the Fair Work Commission. The dispute centred around the terms and conditions of employment of the teachers, including pay rates, hours of work, and other employment-related matters. The Commission was tasked with determining whether the agreement met the necessary standards and requirements under the Fair Work Act 2009.

The primary legal issues before the Commission were whether the agreement provided for fair and reasonable terms and conditions of employment, and whether it met the necessary criteria for approval as set out in the Fair Work Act. The Commission had to consider whether the agreement adequately covered matters such as remuneration, working hours, leave provisions, and other employment conditions. Additionally, the Commission assessed whether the agreement provided for the protection of employees' rights and interests, and whether it was in line with relevant industrial awards and orders.

In making its decision, the Commission carefully reviewed the terms of the agreement and considered submissions from both the Union and the employer. The Commission found that the agreement provided for fair and reasonable terms and conditions of employment, and met the necessary criteria for approval. The Commission noted that the agreement provided for appropriate remuneration, working hours, and leave provisions, and that it adequately protected the rights and interests of the teachers. The Commission also found that the agreement was in line with relevant industrial awards and orders.

The Fair Work Commission approved the St Mary's Child Care Centre Teachers' Agreement 2018, and the decision is now final and binding. The agreement will now govern the terms and conditions of employment for teachers at St Mary's Child Care Centre, and will remain in effect until such time as it is varied or replaced by a new agreement.
