Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Independent Commission Against Corruption Act 1988.

Explanatory note
public authority in section 3 (1) and section 117 (the general regulation-making power).
The object of this Regulation is to declare Crown cemetery trusts as bodies that are public authorities for paragraph (g) of the definition of
the purposes of the Independent Commission Against Corruption Act 1988.

1      Name of Regulation

This Regulation is the Independent Commission Against Corruption Amendment
(Public Authority) Regulation 2014.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Independent Commission Against Corruption Regulation 2010

Clause 18

Omit the clause. Insert instead:

18      Definition of “public authority”

For the purposes of paragraph (g) of the definition of public authority in section 3 (1) of the Act the following are declared to be a body within that definition:

(a) each affiliated health organisation and statutory health corporation,
(b) each reserve trust established under the Crown Lands Act 1989 in relation to a reserve or part of a reserve that is dedicated or reserved for the purposes of a public cemetery or crematorium or a related purpose.
