Independent Cement and Lime Pty Ltdv. Australian Cement Ltd and Ors

Independent Cement and Lime Pty Ltd sought to import cement into Australia from Japan, constructing facilities at Port Melbourne for this purpose. The respondents, Australian Cement Limited and its officers, were alleged to be interfering with these activities. The applicant sought relief under the Trade Practices Act 1974, alleging inducement of breach of contract regarding an agreement with Sumitomo Corporation for the supply of cement. The applicant's motion to restrict inspection of the Sumitomo contract was dismissed, and the respondents' motions to inspect the technical service agreement and obtain additional documents were granted in part. The applicant was ordered to pay the respondents' costs for the application.
