Independent Broad-based Anti-corruption Commission Amendment Regulations 2025

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Independent Broad-based Anti-corruption Commission Regulations 2023—

(a)to update outdated references to the Victorian Inspectorate and the Victorian Inspectorate Act 2011 following the commencement of Division 2 of Part 12 of the Justice Legislation Amendment (Integrity, Defamation and Other Matters) Act 2024; and

(b)to update the prescribed form for a confidentiality notice to reflect the establishment of the Parliamentary Workplace Standards and Integrity Commission under the Parliamentary Workplace Standards and Integrity Act 2024; and

(c)to update the prescribed form for a search warrant to reflect section 91(3)(b) and (c) of the Independent Broad-based Anti‑corruption Commission Act 2011.

2Authorising provisions

These Regulations are made under sections 195 and 196 of the Independent Broad-based Anti‑corruption Commission Act 2011.

3Principal Regulations

In these Regulations, the Independent Broad‑based Anti-corruption Commission Regulations 2023[1] are called the Principal Regulations.

4Form 1 of Schedule 1

In Form 1 of Schedule 1 to the Principal Regulations—

(a)for "the Victorian Inspectorate" (wherever occurring) substitute "Integrity Oversight Victoria";

(b)for "Victorian Inspectorate" (where twice occurring) substitute "Integrity Oversight Victoria";

(c)after—

"·   the Office of the Special Investigator;"

insert—

"·   the Parliamentary Workplace Standards and Integrity Commission;".

5Form 2 of Schedule 1

In Form 2 of Schedule 1 to the Principal Regulations—

(a)for "the Victorian Inspectorate" (wherever occurring) substitute "Integrity Oversight Victoria";

(b)for "Victorian Inspectorate" (where twice occurring) substitute "Integrity Oversight Victoria";

(c)after—

"·   the Office of the Special Investigator;"

insert—

"·   the Parliamentary Workplace Standards and Integrity Commission;".

6Form 5 of Schedule 1

In Form 5 of Schedule 1 to the Principal Regulations—

(a)after "to make a copy of any document relevant" insert ", or that the person executing the warrant reasonably considers may be relevant,";

(b)after "to take possession of any document or other thing" insert "that the person executing the warrant considers".
