REGULATIONS UNDER THE INCOME TAX ASSESSMENT ACT 1936-1967.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Income Tax Assessment Act 1936-1967.

Amendments of the Income Tax Regulations 

Commencement.

1.These Regulations shall come into operation on the first day of October, 1967.

Special areas for purposes of Section 23ac.

2. Regulation 4ad of the Income Tax Regulations is amended by omitting sub-regulation (1.).

Wine and spirit stocks.

3. Regulation 4b of the Income Tax Regulations is amended by omitting the table in sub-regulation (2.) and inserting in its stead the following table:—

5. Regulation 54a of the Income Tax Regulations is repealed and the following regulation inserted in its stead:—

Rates of deduction in absence of claim in respect of dependants.

" 54a. Subject to these Regulations, the prescribed rate at which deductions are to be made for the purposes of section 221c of the Act from the salary or wages of an employee in respect of a week or part of a week is—

(a) where the salary or wages do not exceed One hundred dollars—the rate specified in sub-column (i) of Column 2 of Table A in the Third Schedule to these Regulations opposite to the limits specified in Column 1 of that Table within which the salary or wages are included;

(b)where the salary or wages exceed One hundred dollars but do not exceed Four hundred dollars—the rate specified in Column 2 of Table B in the Third Schedule to these Regulations opposite to the limits specified in Column 1 of that Table within which the salary or wages are included; or

(c) where the salary or wages exceed Four hundred dollars—One hundred and eighty-seven dollars eighty cents plus an amount of Sixty cents for each dollar or part of a dollar by which the salary or wages exceed Four hundred dollars.".

Form of declaration as to dependants.

6. Regulation 54c of the Income Tax Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (6.) the words " One pound five shillings " and inserting in their stead the words " Two dollars fifty cents "; and

(b) by omitting sub-regulation (6b.) and inserting in its stead the following sub-regulation:—

" (6b.) The number of weeks for which a person is a dependant of an employee under the last preceding sub-regulation is—

(a) in the case of a spouse, daughter-housekeeper or parent— the number ascertained by dividing the number of dollars in the amount of the deduction, so reduced, to which the employee would be entitled by six; 

(b) in the case of one child less than sixteen years of age, a student child or an invalid relative—the number ascertained by dividing the number of dollars in the amount of the deduction, so reduced, to which the employee would be entitled by four; or

(c) in the case of any other child—the number ascertained by dividing the number of dollars in the amount of the deduction, so reduced, to which the employee would be entitled by three.".

Third Schedule.

7.The Third Schedule to the Income Tax Regulations is repealed and the following Schedule is inserted in its stead:

8.The Fourth Schedule to the Income Tax Regulations is repealed.

Amendments in relation to decimal currency.

9.The Income Tax Regulations are amended as set out in the Schedule to these Regulations.

Transitional provisions.

10.—(1.) Where—

(a) the prescribed rate at which deductions are to be made for the purposes of section 221c of the Income Tax Assessment Act 1936-1967 from any salary or wages paid to an employee after the commencement of these Regulations would, but for this regulation, be ascertained in accordance with regulation 54b of the Income Tax Regulations by reference to a declaration that the employee furnished to his employer before the commencement of these Regulations; and

(b) the deduction value of a dependant shown in that declaration was Two hundred and eighty-six dollars, One hundred and eighty-two dollars or One hundred and thirty dollars,

the prescribed rate at which deductions are to be made, for the purposes of that section, from the salary or wages of the employee is the rate that would be the prescribed rate by virtue of that regulation if the deduction value of that dependant shown in that declaration had been increased by Twenty-six dollars and the total deduction value of dependants as set out in the declaration had been increased accordingly.

(2.) In the last preceding sub-regulation, references to the deduction value of a dependant and to the total deduction value of dependants have the same respective meanings as in regulation 54c of the Income Tax Regulations.
