Income Tax Regulations (Amendment) (Cth)
STATUTORY RULES
REGULATION UNDER THE INCOME TAX ASSESSMENT ACT 1936-1968.*
I,
THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the
advice of the Federal Executive Council, hereby make the following Regulation
under the

Amendment of the Income Tax Regulations
Regulation 54zf of the Income Tax Regulations is amended—
(
a ) by omitting the definition of “prescribed country”; and(
b ) by adding at the end thereof the following sub-regulations:—“(2.) Subject to the next succeeding sub-regulation, a country, other than Australia, the Government of which is a party to a convention or agreement a copy of which is set out in a Schedule to the
Income Tax (International Agreements )Act 1953-1968, being a convention or agreement—(
a ) the provisions of which, so far as they affect Australian tax, have the force of law as provided by that Act; and(
b ) that contains a provision limiting the amount of Australian tax payable in respect of a dividend,is a prescribed country for the purposes of this Division.
“(3.) Where the
Income Tax (International Agreements )Act 1953-1968 provides that the provisions of a convention or agreement a copy of which is set out in a Schedule to that Act have the force of law in respect of dividends derived on or after a particular day, the country, the Government of which is a party to that convention or agreement, is not a prescribed country for the purposes of this Division before that day.”.
