1. The applicant applies for leave to appeal from a decision of a single Justice of this Court (Edelman J) made on 3 August 2023 refusing the applicant leave to issue or file a proposed writ of summons.

2. There is no reason to doubt the correctness of Edelman J's decision. Leave to appeal should be refused.

3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
