IN THE MATTER OF AN APPLICATION BY DUNCAN DICKSON FOR LEAVE TO APPEAL
[2022] HCASL 67
S17/2022

  1. The applicant requires an extension of time within which to seek leave to appeal from a decision of a single Justice of the High Court of Australia (Edelman J) dismissing the applicant's application for leave to issue or file an application for a constitutional or other writ under r 25.09.1 of the High Court Rules 2004 (Cth). The application for leave to issue or file was necessary by reason of the direction made by Gageler J on 26 April 2019 pursuant to r 6.07.2 of the High Court Rules 2004 (Cth).

  2. There is no reason to doubt the correctness of the decision of Edelman J to dismiss the application for leave.  The application otherwise has no prospect of success and raises no question of principle.  Accordingly, it would be futile to grant the extension of time sought.

  3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
