  1. Keane J refused the applicant leave to issue a proceeding.

  2. The applicant requires leave to appeal against the decision of Keane J: s 34(2) of the Judiciary Act 1903 (Cth). The application filed by the applicant sought leave to appeal against the decision of Keane J but sought orders relating to the proposed special leave application. The Court has considered the application as if it were an application for leave to appeal.

  3. The application for leave to appeal should be refused.  The decision of Keane J was plainly correct.

  4. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
