IN THE MATTER OF AN APPLICATION
BY ANDREW SCOTT ROBERTS
[2015] HCASL 194
H6/2015

  1. The applicant seeks special leave to appeal against the orders of the Supreme Court of Tasmania (Holt AsJ) refusing an application for leave to issue a writ.  Holt AsJ held that the applicant's pleaded claims could not possibly succeed.  Leave was required to issue the writ due to directions made on 30 October 2014 by Pearce J of the Supreme Court of Tasmania.

  2. As the applicant does not have legal representation, the application falls to be dealt with under r 41.10 of the High Court Rules 2004 (Cth).

  3. The applicant requires an extension of time in which to seek special leave to appeal to this Court.  The applicant's draft notice of appeal and written case do not identify any arguable ground of appeal from the decision below.  An appeal to this Court would enjoy no prospects of success.  A grant of an extension of time would be futile.

  4. Pursuant to r 41.10.5, we direct the Registrar to draw up, sign and seal an order dismissing the application.
