1. The applicant requires an extension of time in which to seek leave to appeal from a judgment of Edelman J directing that the applicant's application for leave to file a writ of summons and statement of claim be dismissed without listing it for hearing.

2. It would be futile to grant the extension of time which is sought.  There is no reason to doubt the correctness of Edelman J's judgment.  An appeal to this Court would enjoy no prospect of success.

3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
