Reasons for Decision
On 8 July 2025, Mount Isa City Council ('the Applicant'), pursuant to s 189 of the Industrial Relations Act 2016 (Qld) ('the Act'), made an application to certify Mount Isa City Council Certified Agreement 2024 ('the agreement').
As required by s 189(3) of the Act, the application was made within 21-days of the date on which the agreement was made.
The named parties to the agreement are the Applicant; The Association of Professional Engineers, Scientists and Managers, Australia, Queensland Branch, Union of Employees; Queensland Services, Industrial Union of Employees; The Australian Workers' Union of Employees, Queensland; Construction, Forestry, Mining & Energy, Industrial Union of Employees, Queensland; Plumbers & Gasfitters Employees' Union Queensland, Union of Employees; and Automotive, Metals, Engineering, Printing and Kindred Industries Industrial Union of Employees, Queensland.
The agreement is signed by all the above-mentioned parties. The agreement is to apply to the parties and the Applicant's employees covered by the classifications contained in the agreement.
Having regard to the submissions made by the parties who appeared today,[1] and to the affidavit of Mr Tim Rose, Chief Executive Officer of Mount Isa City Council, affirmed on 18 June 2025:
·I am satisfied of each relevant requirement in ch 4, pt 5, div 2, sub-div 2 of the Act; and
·there is nothing in the agreement which would require me to refuse to grant the application pursuant to ch 4, pt 5, div 2, sub-div 3 of the Act.
[1] I also note the correspondence of Mr Rohan Webb, State Secretary of Automotive, Metals, Engineering, Printing and Kindred Industries Industrial Union of Employees, Queensland ('AMWU') dated 10 July 2025 where Mr Webb writes that AMWU supports the termination and certification applications but would be unable to attend the hearing. Further, I note the correspondence of Mr Justin Maxwell, A/State Secretary of the Plumbers & Gasfitters Employees' Union Queensland, Union of Employees ('the PGEU') dated 10 July 2025 confirming the PGEU's consent to the termination and certification applications to be made in their absence as they were unable to attend the hearing. Further, I note the correspondence of Ms Mahdi Heidari, Organiser for the The Association of Professional Engineers, Scientists and Managers, Australia, Queensland Branch, Union of Employees ('Professionals Australia') dated 13 July 2025 confirming consent to the application and sought leave to be excused from attending at the hearing as they would be unable to attend the hearing.
The application to certify the Mount Isa City Council Certified Agreement 2024 is granted.
The Mount Isa City Council Certified Agreement 2024 operates from the day it is certified, namely 21 July 2025.
Although the nominal expiry date of the Mount Isa City Council Certified Agreement 2024 is 1 July 2028, it continues to operate until it is terminated under s 227 or s 228 of the Act.
I make the following order:
