1  Name

This instrument is the Imported Food Control Amendment (Pure and Highly Concentrated Caffeine Products) Order 2019.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under section 10 of the Imported Food Control Regulations 2019.

Omit “regulation 10”, substitute “section 10”.

2  Clause 1 of Schedule 1 (at the end of the table)

Add:

Food in which caffeine is present at a concentration of:

(a) 5% or greater, if the food is a solid or semi‑solid food; or

(b) 1% or greater, if the food is a liquid food.
