REGULATIONS UNDER THE IMMIGRATION ACT 1901-1940 *

I, THE GOVERNOR-GENERAL, in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Immigration Act 1901-1940.

Amendment to the Immigration Regulations. 

Certificate of exemption.

1. Regulation 39 of the Immigration Regulations is amended by adding at the end thereof the following sub-regulation:—

“(2.) Every person to whom a certificate of exemption is issued shall retain such certificate while he remains in the Commonwealth, but shall return it to an officer forthwith when it expires or is cancelled or immediately prior to his departure from the Commonwealth, whichever is the earliest.”

Amendments of the Schedule.

2. The Schedule to the Immigration Regulations is amended—

(a) by omitting from the Forms contained therein the figures “1901-1932” (wherever occurring) and inserting in their stead the figures “1901-1940”; and

(b) by omitting Form D. and inserting in its stead the following Form:—

CERTIFICATE OF EXEMPTION.

This is to certify that who is described hereunder, is authorized to enter or remain in the Commonwealth without being subject to any of the provisions of the Immigration Act 1901-1940 restricting entry into or stay in the Commonwealth.

“NOTE:—Sub-sections (2.), (3,), (4.), and (5.) of section 4 of the Immigration Act 1901-1940 are as follows:—

‘4.—(2.) The certificate shall be expressed to be in force for a specified period only, but the period may be extended from time to time by the Minister or by an authorized officer.

‘(3.) Any such certificate may at any time be cancelled by the Minister by writing under his hand.

‘(4.) Upon the expiration or cancellation of any such certificate, the person named therein may, if found within the Commonwealth, be declared by the Minister to be a prohibited immigrant and may thereupon be required by notice in writing given by an authorized officer, in accordance with the directions of the Minister, to leave the Commonwealth within a period to be specified in the notice.

‘(5.) If the person fails to leave the Commonwealth within the period specified in the notice, he may be deported from the Commonwealth pursuant to an order of the Minister.’.

Regulation 17 of the Immigration Regulations is as follows:—

‘17. Any person who with intent to contravene or evade the Act, or these Regulations, or without just cause or excuse, transfers or delivers up to any other person any passport, certificate, permit, credentials, or identification card referred to in the Act or in these Regulations shall be guilty of an offence against these Regulations.’

Sub-regulation (2.) of Regulation 39 of the Immigration Regulations is as follows:—

‘39.— (2.) Every person to whom a certificate of exemption is issued shall retain such certificate while he remains in the Commonwealth, but shall return it to an officer forthwith when it expires or is cancelled or immediately prior to his departure from the Commonwealth, whichever is the earliest.’.

Regulation 43 of the Immigration Regulations is as follows: —

‘43. Any person who is guilty of an offence against these Regulations is under section eighteen of the Act, liable, upon summary conviction, to a penalty not exceeding £50, and, in default of payment, to imprisonment with or without hard labour for any period not exceeding three months “.
