Immigration (Education) Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Immigration (Education) Act 1971.

1.   Commencement

1.1   These Regulations commence on 1 July 1997.

2.   Amendment

2.1   The Immigration (Education) Regulations are amended as set out in these Regulations.

3.   Regulation 4 (Fees—prescribed English courses)

3.1   Subregulation 4 (3):

Add at the end:

“; or (c) the holder of an Interdependency (Provisional) (Class UG) or Spouse (Provisional) (Class UF) visa; or

  • (d)

    the holder of a Subclass 820 (Spouse) or Subclass 826 (Interdependency) visa.”. 

4.   New regulation 5A

4.1   After regulation 5, insert:

Persons excluded from English tuition—paragraphs 4B (e) and 4C (e) of the Act

 “5A.A person for whom an English course has been provided under section 4 of the Act is excluded from being provided with English tuition under section 4B or 4C of the Act.”.
