1. This application for special leave to appeal does not raise a question of general principle and it is not otherwise in the interests of justice that leave to appeal be granted.  In any event, an appeal to this Court would not enjoy sufficient prospects of success to warrant a grant of special leave to appeal.  The application for special leave to appeal should be dismissed.

2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
