1      Name of Plan

This Plan is Hurstville Local Environmental Plan 2012 (Amendment No 12).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to the following land in Hurstville:

(a)

29 MacMahon Street, being SP 12396,

(b)

31 MacMahon Street, being Lot 10, Section A, DP 1297 and Lot 11, DP 455603.

4      Maps

The maps adopted by Hurstville Local Environmental Plan 2012 are amended or replaced, as the case requires, by the maps approved by the Greater Sydney Commission on the making of this Plan.

5 Amendment of Hurstville Local Environmental Plan 2012

Clause 4.4A Non-residential floor space ratios

Insert after clause 4.4A (1):

(1B)

Despite clause 4.4, development consent must not be granted for development on the following land unless the non-residential floor space ratio is at least 0.5:1:

(a)

29 MacMahon Street, Hurstville, being SP 12396,

(b)

31 MacMahon Street, Hurstville, being Lot 10, Section A, DP 1297 and Lot 11, DP 455603.
