Clause 1 Hurstville Local Environmental Plan 1994 (Amendment No 40)

Hurstville Local Environmental Plan 1994 (Amendment

No 40)

under the

Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Hurstville Local Environmental Plan 1994 (Amendment

No 40).

2      Aims of plan

This plan aims:

(a)	to rezone part of the land to which this plan applies (being land in private ownership) from Zone No 6 (a) (the Open Space Zone) to Zone No 2 (the Residential Zone) under Hurstville Local Environmental Plan 1994 (the 1994 plan), and
(b)	to rezone the remainder of the land (being community land) from the Residential Zone to the Open Space Zone under the 1994 plan,

so as to correct the zoning map for the 1994 plan which shows the

two parcels of land with incorrect zoning.

3      Land to which plan applies

(1)	To the extent that this plan rezones part of the land to the Residential Zone under the 1994 plan, it applies to land known as 226 Carrington Avenue, Hurstville (Lot A, DP 369697), as shown coloured light pink on Sheet 1 of the map marked “Hurstville Local Environmental Plan 1994 (Amendment No 40)” deposited in the office of the Council of the City of Hurstville.
(2)	To the extent that this plan rezones the remainder of the land to the Open Space Zone under the 1994 plan, it applies to land known as 196 Gloucester Road, Hurstville (Lot 101, DP 589790), as shown coloured green on Sheet 2 of that map.

4 Amendment of Hurstville Local Environmental Plan 1994

Hurstville Local Environmental Plan 1994 is amended by inserting in appropriate order in the definition of the map in clause 5 (1) the following words:
