An Act to sanction the procuring and laying of a second pipe-line from Walka to Buttai in connection with the Hunter District Water Supply; to provide for transferring to and vesting in the Hunte r District Water Supply and Sewerage Board the property in and the control and manage­ ment of the said work; and for purposes incidental thereto. [15th November, 1895.J

w H E R E AS, in accordance with the provisions of the Public

Works Act of 18S8, the Legislative Assembly did by resolu- t ion declare that it was expedient to carry out a certain proposed Public Work, namely, the laying of a second pipe-line from Walka to Buttai in connection with the Hunter District Water Supply : And whereas on the passing of the said resolution a statutory duty was by the said Act imposed on the Secretary for Public Works to introduce a Bill into the said Assembly to sanction the carrying out of the said work : Be it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—•

1. The carrying out of the said work more particularly described in the Schedule to this Act is hereby sanctioned ; and the Secretary for Public Works, or the Member of the Executive Council for the time being performing the duties of the said Secretaiy, is hereby authorised to undertake; and carry out the said work subject to the provisions of this Act, and for that purpose shall be; and shall have the powers and duties of a Constructing Authority within the meaning of the Public Works Act of 1888.

2. The plan of the said work is the plan marked " Hunter District Water Supply (Partial Duplication)," signed by the Secretary for Public Works and countersigned by the Enginecr-in-Chief for Public Works, and deposited in the office of the said Secretary.

Water Supply and Sewerage Acts Amendment Act of 1891.

3. The cost of carrying out the said work, estimated at thirty- four thousand five hundred pounds, may be defrayed from such Loan Votes as are now or may hereafter be applicable to that purpose, and shall not under any circumstances exceed the estimated cost by more than ten per centum.
4. On completion of the work hereby sanctioned, the Governor shall forthwith notify the same in the Gazette. And upon that notification being made, there shall, by virtue of this Act alone, be transferred to and vested in the Hunter District Water Supply and Sewerage Board absolutely, but for and on behalf of Her Majesty, the property in and the control and management of the said work.

The work hereby sanctioned shall, upon being transferred to and vested in the said Board, be deemed to be works carried out- under the Hunter District Water Supply and Sewerage Act of 1892 within the meaning of that Act and the Country Towns and Hunter District

5. This Act may be cited us the " H u n t e r District Water Supply (Partial Duplication) Act, 1895," and shall be construed as one with the Hunter District Water Supply and Sewerage Act of 1892, and with sections four and five of the Country Towns and Hunter District Water Supply and Sewerage Acts Amendment Act of 1894, and with so much of section six of the last-mentioned Act as relates to works or lands acquired by the Hunter District Water Supply and Sewerage Board.

SCHEDULE.

Hunter District Water Supply.

Duplicate suction and rising main pipe-line from Walka to Buttai Hill, through the

parish of Maitland, county of Northumberland.

1. Tho procuring and laying of a line of twenty-inch steel suction and rising main pipes to meet the requirements of tho Hunter District in the event of an accident happening to the existing single lines of cast-iron pipes, and also in anticipation of tho time when the existing pipes will not ho large enough to supply the said district.

2. Tho new pipes "Co be laid in close proximity to the existing pipes along the lines shown on the plan referred to in section two of this Act.
