CaseChat Overview and Summary
The central legal issue before the Commission was whether the agreement met the requirements for approval under the Fair Work Act 2009. Specifically, the Commission needed to determine if the agreement had been made in good faith, if it provided for proper procedures for the resolution of disputes, and if it complied with the relevant provisions of the Act. The Commission also had to consider if the agreement was made in accordance with the principles of enterprise bargaining and if it provided for a fair and reasonable outcome for all parties involved.
The Commission found that the agreement was made in good faith, provided for proper procedures for the resolution of disputes, and complied with the relevant provisions of the Fair Work Act 2009. The Commission also found that the agreement was made in accordance with the principles of enterprise bargaining and provided for a fair and reasonable outcome for all parties involved. The Commission was satisfied that the agreement met the necessary criteria for approval and granted the application for the agreement to be registered.
The Fair Work Commission approved the Roy Hill AWU Greenfields Agreement 2014 as a registered agreement, effective from the date of the decision. The agreement will now have the force of a registered agreement under the Fair Work Act 2009, and will apply to the employees covered by the agreement. The Commission's decision ensures that the agreement provides for a fair and reasonable outcome for all parties involved, and that it complies with the relevant provisions of the Act.
