Humes was convicted in the District Court of possession of a trafficable quantity of methylamphetamine with intent to sell or supply to another and possession of cash reasonably suspected to have been stolen or unlawfully obtained. The appellant was sentenced to 6 years 2 months imprisonment on the first count and 6 months imprisonment on the second count, to be served concurrently. The appellant appealed the severity of the sentence, as well as alleged errors made by the sentencing judge. The Court of Appeal dismissed the appeal against the sentence for possession of cash and rejected the alleged errors made by the sentencing judge. However, the Court of Appeal held that the sentence for possession of the methylamphetamine was manifestly excessive and resentenced the appellant to 5 years imprisonment, with eligibility for parole.
