Human Tissue and Transplant Amendment Regulations 2024

Made by the Governor in Executive Council.

1.Citation

These regulations are the Human Tissue and Transplant Amendment Regulations 2024.

2.Commencement

These regulations come into operation as follows —

• (a)

  regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

• (b)

  the rest of the regulations — on the day after that day.

3.Regulations amended

These regulations amend the Human Tissue and Transplant Regulations 2024.

4.Regulation 4 amended

• (1)

  In regulation 4(1) insert in alphabetical order:

   

equivalent rule, in relation to a rule made under the Therapeutic Goods Act, means the rule that —

• (a)

  applies as a law of the State under the Therapeutic Goods Law Application Act 2024 section 10; and

• (b)

  is equivalent to the rule made under the Therapeutic Goods Act;

equivalent section, in relation to a section of the Therapeutic Goods Act, means the section of the Therapeutic Goods Act that —

• (a)

  applies as a law of the State under the Therapeutic Goods Law Application Act 2024 section 5; and

• (b)

  is equivalent to the section of the Therapeutic Goods Act;

TG law provision has the meaning given in section 29A(1).

• (2)

  In regulation 4(1) in the definition of TGA provision delete “29A(1).” and insert:

   

29A(1);

• (3)

  In regulation 4(2):

  • (a)

    delete “TGA provisions” and insert:

     

  TG law provisions

   
  • (b)

    in paragraph (i) delete “41HC(6).” and insert:

     

  41HC(6);

   
  • (c)

    after paragraph (i) insert:

     
  • (j)

    the equivalent section of each section of the Therapeutic Goods Act prescribed under paragraphs (a), (b), (d), (e), (g) and (h);

  • (k)

    the equivalent rule of each rule made under the Therapeutic Goods Act prescribed under paragraphs (c), (f) and (i).
