Housing Indemnity Amendment Regulations 2002

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Housing Indemnity Act 1992 .20 May 2002

1Short titleThese regulations may be cited as the Housing Indemnity Amendment Regulations 2002 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Housing Indemnity Regulations 1993 are referred to as the Principal Regulations. 4Regulation 10 substituted Regulation 10 of the Principal Regulations is rescinded and the following regulation is substituted: 10Exemption (1) Building work performed by, for or on behalf of an owner-builder is exempt from the application of section 11 of the Act. (2) Building work performed by, for or on behalf of the Crown is exempt from the application of section 11 of the Act. (3) Building work performed by, for or on behalf of a builder is exempt from the application of section 11 of the Act if – (a) the builder has entered into an agreement in respect of housing indemnity with the Master Builders’ Association of Tasmania; and (b) before entering into that agreement the Master Builders’ Association of Tasmania has consulted with the Minister in relation to that agreement.
