Housing and Urban Development (Administrative Arrangements) (Riverbank Authority) Regulations 2014

under the Urban Renewal Act 1995

1Short title

These regulations may be cited as the Housing and Urban Development (Administrative Arrangements) (Riverbank Authority) Regulations 2014.

2Commencement

These regulations come into operation on the day on which they are made.

3Interpretation

In these regulations—

Act means the Housing and Urban Development (Administrative Arrangements) Act 1995;

Authority means the statutory corporation established under regulation 4;

land includes a building;

precinct means the area delineated in the map set out in Schedule 1 (and in accordance with the detail set out in the maps in Schedule 2 to Schedule 8 (inclusive)).

4Establishment of Riverbank Authority

The Riverbank Authority is established as a statutory corporation under the Act.

5Board of management

The board of management of the Authority will be constituted of 5 persons, each of whom must have a leadership role or experience in, or knowledge of, 1 or more of the following fields:

  1. (a)

    major commercial and institutional urban development and financing;

  2. (b)

    tourism;

  3. (c)

    event marketing and promotion;

  4. (d)

    urban planning and design;

  5. (e)

    community and stakeholder engagement relating to major development (including urban renewal);

  6. (f)

    management and operation of the Adelaide Park Lands;

  7. (g)

    public or private sector governance.

6Functions of Authority

The functions of the Authority are as follows:

  1. (a)

    to give advice and make recommendations to Government about major infrastructure proposals and funding mechanisms for the development of land within the precinct;

  2. (b)

    to oversee and be accountable for the delivery of the implementation plan for the precinct (known as the Greater Riverbank Precinct Implementation Plan) and other master plans for the precinct (including to oversee the preparation of other master plans);

  3. (c)

    to promote and encourage the involvement of the private sector in the development of key sites within the precinct;

  4. (d)

    to facilitate appropriate State and Local Government involvement in the design and development of a consistent, safe and high quality public realm within the precinct;

  5. (e)

    to plan, coordinate and carry out relevant marketing, communications and promotions within the precinct;

  6. (f)

    to act as a referral authority for the purpose of giving advice on proposals that contain recommendations to Cabinet about development within the precinct;

  7. (g)

    to promote tourism in relation to the precinct;

  8. (h)

    to promote recreational, social and cultural activities in relation to the precinct;

  9. (i)

    to undertake event coordination and management within the precinct;

  10. (j)

    to liaise with The Corporation of the City of Adelaide, the Adelaide Park Lands Authority and other persons or bodies with an interest in the precinct;

  11. (k)

    to engage the persons and bodies referred to in paragraph (j) in the planning and development of the precinct;

  12. (l)

    to work to ensure community involvement in and support for the delivery of the Greater Riverbank Precinct Implementation Plan;

  13. (m)

    to carry out any other functions conferred on the Authority by the Minister.

7Specific powers of Authority

In addition to the powers conferred on a statutory corporation by or under the Act, the Authority may, in accordance with the Act—

  1. (a)

    acquire, hold, deal with and dispose of land and other assets for the purpose of carrying out its functions; and

  2. (b)

    raise capital, borrow money and obtain other forms of financial accommodation; and

  3. (c)

    transfer an asset, right or liability to the Minister or another body; and

  4. (d)

    engage persons as agents or consultants, and enter into other forms of contract for the provision of services; and

  5. (e)

    make use of the services, facilities or staff of other government departments, agencies or instrumentalities, or private sector bodies.

8Application of provisions of Public Corporations Act 1993 to Authority

Sections 8 to 10 and Part 3 of the Public Corporations Act 1993 apply to the Authority.
