2 Sugar Industry Regulation 1991 ˙ Commencement 2.(1) Subject to subsection (2), this by-law commences on publication in the Gazette. (2) Sections 6, 7 and 8 commence on 1 September 1992. ˙ Amended by-laws 3. The Habitation of Houseboats and Vessels By-laws 1978 are amended as set out in this by-law. ˙ Name of provision units 4. (1) A provision of the Habitation of Houseboats and Vessels By-laws 1978 that was, immediately before the commencement of this section, called a By-law may be called a section. (2) A provision of the Habitation of Houseboats and Vessels By-laws 1978 that was, immediately before the commencement of this section, called a clause may be called a subsection. (3) A reference in the Habitation of Houseboats and Vessels By-laws 1978 to a By-law or clause of the by-laws designated by a number is a reference to a section or subsection of the by-laws designated by that number. ˙ Replacement of s. 2 (Citation and Commencement) 5. Section 2— omit, insert— ‘Short title ‘2. This by-law may be cited as the Houseboats By-law 1978 .’. ˙ Amendment of s. 3 (Definitions) 6. Section 3— insert—
3 Sugar Industry Regulation 1991 ‘ “Uniform Code” means the Uniform Shipping Laws Code adopted by the Conference of Commonwealth and State Ministers known as the Australian Transport Advisory Council; ‘ “waste holding system” means a system designed to collect, store and discharge sewage and sullage efficiently. ’. ˙ Insertion of new s. 8A 7. After section 8— insert— ‘Waste holding systems ‘8A. (1) The owner of a vessel that— (a) is used in the waters set out in Schedule C; and (b) has a flush toilet or washing facilities; must ensure that it has a waste holding system. ‘(2) The waste holding system must— (a) be fitted with a tank constructed in accordance with the relevant requirements of sections 5 and 9 of the Uniform Code; and (b) be fitted with a visible and audible alarm at the vessel’s control station to warn when the waste holding system is full; and (c) be fitted with vents that terminate— (i) at least 450mm above deck; and (ii) in a gooseneck; and (iii) away from passenger areas; and (d) be designed to prevent back flooding; and (e) be resistant to internal corrosion. ‘(3) If a pipe used in a waste holding system is positioned below a point 0.3m above the load line, it must be made from a material resistant to— (a) corrosion; and
4 Sugar Industry Regulation 1991 (b) sea water; and (c) heat; and (d) oil; and (e) vibration. ‘(4) If flexible hose is used in a waste holding system, the hose must be connected, at each end, with double stainless steel screwed clips. ‘(5) The owner of the vessel must dispose of the contents of the waste holding system ashore in accordance with the statutory rules of the relevant local authority. ’. ˙ Insertion of new Schedule C 8. After Schedule B— insert— ‘SCHEDULE C ‘Waste holding system areas Noosa River upstream from Munna Point. ’. ENDNOTES 1. Made by the Harbours Corporation on 22 October 1991. 2.
