E it enacted by the Queen’s Most Excellent Majesty B by and with the advice and consent of the Legis lative Assembly of Queensland in Parliament assembled and by the authority of the same, as follows:— 1. (1.) This Act may be cited as “ The Hotel Short title- Theodore Sale Act Amendment Act of 1959.” (2.) *“ The Hotel Theodore Sale Act of 1954 ” is in Principal this Act referred to as the Principal Act. Act‘ (3.) The Principal Act and this Act may be Collective collectively cited as “ The Hotel Theodore Sale Acts ,tlte* 1954 to 1959.” 2. Section five of the Principal Act is amended Amendment by adding thereto the following subsection :— of s"5’ “ (6.) The provisions of this section shall not limit or be deemed ever to have limited— (a) The power of the Hotel Theodore Co-operative Association Limited to mortgage from time to time the Perpetual Town Lease issued in pursuance of this Act to a person other than a society formed and registered under t“ The Co-operative Societies Acts, 1946 to 1951,” under a mortgage containing a power of sale by the mortgagee, his executors, administrators or assigns, in case of default of payment of any principal or interest moneys secured by the mortgage, or of breach of any of the conditions therein contained or implied; or ( b) The power of the mortgagee duly exercising the power of sale contained in a mortgage mentioned in paragraph (a) of this subsection to sell the Perpetual Town Lease issued in pursuance of this Act to a person other than » 3 Eliz. n. No. 68, a society formed and registered under *“ The Co-operative Societies Acts, 1946 to 1951,” or of any person to whom the said Perpetual Town Lease is so sold to take and hold the same.” Amendment 3. Section seven of the Principal Act is amended of s. 7. by adding thereto the following proviso :— “ Provided that, in the event and by virtue of the sale of the Perpetual Town Lease issued in pursuance of this Act by a mortgagee thereof duly exercising the power of sale contained in the mortgage, sections five and six of this Act shall cease to apply with respect to the person to whom the said Perpetual Town Lease is so sold or any person thereafter becoming in relation thereto the lessee or sublessee, save that the provisions of subsection one of section six of this Act shall continue to apply to the extent to which those provisions continue in force the licensed victualler’s license in respect of the Hotel Theodore.” MACKAY FLOODS RELIEF.
