Hospitals and Health Services (Central Great Southern Health Service Board) By-laws 2000
Made by the Central Great Southern Health Service Board under section 22 of the Act.
1. Citation
These by-laws may be cited as the Hospitals and Health Services (Central Great Southern Health Service Board) By-laws 2000.
2. Definition
In these by-laws -
"Board" means the hospital board assigned the corporate name"Central Great Southern Health Service Board" under
clause 4 of the Hospitals and Health Services
determined by the Board and approved by the Minister. (Reorganisation of Hospital Boards) Notice 2000.
3. Local health service councils to be established
The Board is to establish a local health service council for each public hospital under the control of the Board.
4. Constitution of local health service councils
(1)
A local health service council is to consist of not less than 3 persons or more than 9 persons appointed by the Board.
(2) Subject to sub-bylaw (1)-
(a)
at least 2 persons are to be appointed to a local health service council from the members of the Board; and
(b)
at least one person is to be appointed from persons nominated to the Board in accordance with procedures

5. Chairperson
The members of a local health service council are to elect one of those members to be the chairperson of the council.
6. Constitutional provisions
(1) Subject to sub-bylaw (2), the Schedule to the Act has effect in
relation to the constitutional provisions that apply to a local
health service council.(2) For the purposes of sub-bylaw (1) - (a) a reference in the Schedule to the Act -
(i) to the Governor or the Minister is taken to be a reference to the Board; or
(ii) to the Chairman is taken to be a reference to the chairperson;
(b) clauses 3 and 12 of that Schedule do not apply; and
(c) the reference in clause 14 of that Schedule to "this Act"
is taken to be a reference to "any directions given by the
Board".
7. Functions of local health service council
The functions of a local health service council established for a public hospital are -
(a)
to supervise the management of the public hospital and the local health services provided by the public hospital;
(b)
to select for recommendation to the Board the person who is to be employed as the senior employee of the public hospital;
(c)
to prepare, and present to the Board, a business plan that includes recommendations as to the allocation of funds
by the Board; (d)
to ensure that the funds available to the Board for allocation to the public hospital are managed in accordance with the objectives of the business plan that have been agreed to by the Board;
(e)
to participate in strategic planning processes in relation to the public hospital and the local health services provided by the public hospital;
(f)
to supervise contracts or other arrangements entered into by the Board for the purposes of the local health services provided by the public hospital;
(g)
to determine the range of local health services to be provided by the public hospital from the funds allocated in accordance with the agreed business plan;
(h)
to manage and maintain anything donated by the local community for the benefit of the public hospital;
25 July 2000] GOVERNMENT GAZETTE, WA 3909 (i) to provide advice and recommendations to the Board on any matter mentioned in this by-law or on any other matter on which the council considers it appropriate to provide advice or recommendations to the Board; and
(j) to perform any other functions as directed by the Board. 8. Board may give directions to local health service councils
The Board may give directions to a local health service council in relation to the performance of the council's functions, and the council is to comply with any direction so given.
