Hospitals Acts Amendment Act of 1967
138 Ourmsfanb: ANNO SEXTO DECIMO `,LIZABETHAE SECUNDAE REGINAE No. 21 of 1967 An Act to Amend " The Hospitals Acts, 1936 to 1964,19 in certain particulars [ASSENTED TO 7TH APRIL, 1967] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title . This Act may be cited as " The Hospitals Acts Amendment Act of 19670" (2) Principal Act. " The Hospitals Acts, 1936 to 1964, " are in this Act referred to as the Principal Act.
Hospitals Acts Amendment Act of 1967, -No. 21 139 (3) Collective title. The Principal Act and this Act may be collectively cited as " The Hospitals Acts, 1936 to 1967." 2. Amendments of s. 18 . Section eighteen of the Principal Act is amended- (a) by omitting subsections (1) and (IA) thereof and inserting in their stead the following subsections:- " (1) Appointment by Board of officers except secretary , &c. Subject to this Act a Board may from time to time appoint such officers and other employees (other than a secretary and an assistant secretary) as the Board may deem necessary for the exercise and performance of its functions under this Act or any other Act. A person appointed pursuant to this subsection shall be employed on such terms and conditions and be paid such remuneration as is, from time to time, provided for in any industrial award or industrial agreement applicable with respect to such person. (IA) Appointment of secretary , & c., by Governor in Council. The Governor in Council may appoint a secretary, and where he deems necessary an assistant secretary, of a Board. Such an appointment shall be made under " The Public Service Acts, 1922 to 1965" (herein called "those Acts ") and the appointee shall- (a) hold office under, subject to and in accordance with those Acts; (b) be deemed to be an officer of the Department administered by the Minister for the time being administering this Act; and (c) be entitled to hold such appointment in conjunction with any other appointment under those Acts. The salary of the secretary and, as the case may be, assistant secretary shall be paid by the Board concerned. A person holding office as secretary of a Board pursuant to the provisions of section eighteen of " The Hospitals Acts, 1936 to 1964 " (herein called the " amended section ") immediately prior to the passing of " The Hospitals Acts Amendment Act of 1967 " shall be deemed to have been appointed to that office pursuant to the provisions of this section on and from the date of his appointment pursuant to the provisions of the amended section.";
140 Hospitals Acts Amendment Act of 1967, No. 21 (b) in subsection (1B) by inserting after the words " of secretary where appearing four times the words " or assistant secretary "; and (c) by omitting subsection (2). 3. Amendment of s. 20. Section twenty of the Principal Act is amended by adding the following subsection:- (6) Subsection (5) of this section does not apply with respect to a contract for the execution of any work or the furnishing of any goods or materials entered into by a Board with a Department of the Government, a Crown corporation or instrumentality or a corporation or instrumentality representing the Crown, or any other Hospitals Board, or to such a contract entered into by a Board with the State Stores Board or entered into by the State Stores Board for a Board." 4. Amendment of s. 26. Section twenty-six of the Principal Act is amended by adding the following subsection:- " (9) The North Brisbane Hospitals Board is, and it is hereby declared always was, authorised to carry on the business of supplying the requirements of that Board, other Boards and Ambulance Transport Brigade Committees in respect of goods and materials required to enable a Board or an Ambulance Transport Brigade Committee to duly do and perform its functions, it being hereby declared that the said Board is and always was authorised to take and do all steps and things deemed by it necessary or convenient for carrying out the object of this subsection."
