191 (turenslun^ ANNO TERTIO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 18 of 1964 An Act to Amend " The Hospitals Acts, 1936 to 1962," in certain particulars [ASSENTED TO 8TH APRIL, 1964] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title . This Act may be cited as " The Hospitals Acts Amendment Act of 1964." (2) Principal Act. " The Hospitals Acts, 1936 to 1962," are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as " The Hospitals Acts, 1936 to 1964."
192 Hospitals Acts Amendment Act of 1964, No. 18 2. Amendments of s. 5 . Section five of the Principal Act is amended by- (a) omitting the first paragraph and inserting in its stead the following paragraphs:- " Every appointee as medical superintendent, medical officer or matron of a hospital shall be a person approved by the Director-General. Where a Board has invited applications for any appointment to which this section applies, such Board shall submit to the Director-General all applications received by it, and shall appoint an applicant approved by the Director-General. The Director-General may approve for appointment a panel of two or more of the applicants, in which case the Board may appoint any person included in the panel: 9 ; (b) in the second paragraph, being the proviso to the first paragraph, omitting the words " in making his investigation and preparing his report " and inserting in their stead the words " in determining whether or not he will approve any person for an appointment to which this section applies under this section." 3. New s. 5B inserted . The Principal Act is amended by inserting after section 5A the following section:- " [5B.] Director of Dental Services in Queensland . (1) The Governor in Council may appoint a Director of Dental Services in Queensland and such other officers as he deems necessary for the effectual administration of the provisions of this Act relating to the functions and duties of the said Director. Every such appointment shall be made and the appointee shall hold his office under, subject to and in accordance with " The Public Service Acts, 1922 to 1963." (2) Subject to the Director-General, the Director of Dental Services shall be charged with the general supervision and control of dental clinics and dental hospitals controlled by Boards, and of dental services provided or controlled by any Department of Government, and of dental treatment in or provided by all such dental clinics; dental hospitals and dental services and in particular shall be responsible for making recommendations with respect to- (a) the organisation and co-ordination of such dental services; (h) the provision of plant, equipment, furniture, drugs and supplies for dental clinics, dental hospitals and dental services as aforesaid ; (c) the provision of new dental clinics or dental hospitals under the control of Boards, or of new dental services by or under the control of Departments of Government; and (d) the planning by Boards of new buildings for dental clinics or dental hospitals or of extensions to or alterations of existing such buildings and in particular the internal lay-out of such new or extended or altered buildings and the plant equipment and furniture required therefor.
Hospitals Acts Amendment Act of 1964, No. 18 193 (3) Every appointee as dentist or dental mechanic in a dental clinic or dental hospital under the control of a Board shall be a person approved by the Director of Dental Services in Queensland. Where a Board has invited applications for any appointment to which this subsection applies, such Board shall submit to the said Director all applications received by it, and shall appoint an applicant approved by the said Director. The Director of Dental Services in Queensland may approve for appointment a panel of two or more of the applicants, in which case the Board may appoint any person included in the panel." 4. New s. 5C inserted . The Principal Act is amended by inserting after section 5g, as previously inserted by this Act, the following section- [5C.] Central Accounting Bureau . (1) In this section- (a) the term " the Central Accounting Bureau " means the organisation established for the purposes of the co-ordinated exercise and control of the functions duties and responsibilities of a financial nature of The North Brisbane Hospitals Board, The South Brisbane Hospitals Board, and any other Board which may be constituted for a District situated within the area comprised by the City of Brisbane and the City of Redcliffe; and (b) the term " the secretary " means the person who is the secretary under and within the meaning of this Act of each of the Boards respectively in respect of which the Central Accounting Bureau is established for the time being. (2) Unless and until otherwise determined by the Governor in Council The North Brisbane Hospitals Board shall provide office accommodation, furniture and equipment, including books and stationery, for the Central Accounting Bureau. (3) Officers other than the Officer in Charge, Central Accounting Bureau , may be appointed by The North Brisbane Hospitals Board or any other Board in respect whereof the Central Accounting Bureau is established for the time being to administer the Central Accounting Bureau. Any such appointee shall be an employee of the Board by which he is appointed. Any dispute respecting any such appointment shall be determined by the Minister and the Boards which are parties to the dispute shall abide by the determination. (4) The Officer in Charge, Central Accounting Bureau , shall be appointed by the Governor in Council subject to and in accordance with " The Public Service Acts, 1922 to 1963," and for the purpose of the application of those Acts the office of Officer in Charge, Central Accounting Bureau , shall be deemed to be an office within the Department of Health. (5) Subject to subsection (4) of this section and as herein provided the Officer in Charge, Central Accounting Bureau , shall have the complete control and supervision of the Central Accounting Bureau. 7
194 Hospitals Acts Amendment Act of 1964, No. 18 The Officer in Charge, Central Accounting Bureau shall be immediately responsible to the secretary. (6) During the absence for any cause whatsoever of the person for the time being holding the office of Officer in Charge, Central Accounting Bureau the duties authorities and powers appertaining to that office may be discharged by such person (including an officer of the Public Service) as may be determined by the secretary unless otherwise directed by the Minister." 5. Amendment of s. 14 . Section fourteen of the Principal Act is amended by omitting subsection (3) and inserting in its stead the following subsection:- " (3) At the request of the chairman, or at any time when the chairman is unable by reason of illness, absence or other cause whatsoever to exercise his office as such, the deputy chairman may act as chairman and when so acting shall have and exercise the powers, functions and duties of the chairman. The deputy chairman shall act as the chairman of any meeting at which he is present during any absence of the chairman from the meeting." 6. Amendment of s. 17 (2). Subsection (2) of section seventeen of the Principal Act is amended by adding thereto the following paragraph- " This subsection does not apply to minutes recorded in the minute books of proceedings of any committee appointed by the Board, or of the Board sitting as a committee of the whole number of the members thereof, at any sittings of such committee or committee of the whole number of members which is not open to the public." 7. Amendment of s. 18B (1). Subsection (1) of section 18a of the Principal Act is amended by omitting subparagraphs (i) and (ii) of paragraph (c) and inserting in their stead the following subparagraphs: - " (i) where an officer employed by any of the following Boards, namely The North Brisbane Hospitals Board, The South Brisbane Hospitals Board, or some other Board constituted for a District situated within the area comprised by the City of Brisbane and the City of Redcliffe is an applicant for a vacancy in a clerical office or a new clerical office in the employment of another of those Boards, then such officer shall be deemed to be employed by such lastmentioned Board; (ii) where an applicant for a vacancy in a clerical office or a new clerical office in the employment of any Board mentioned in subparagraph (i) of this paragraph (c) is employed or is deemed by the said subparagraph (i) to be employed by such Board, then all employment had by such applicant as an officer with such Boards or any of them shall be taken into account as if it had been employment by the Board to which the application relates; ".
Hospitals Acts Amendment Act of 1964, No. 18 195 8. Amendment of s. 21 (1). Subsection (1) of section twenty-one of the Principal Act is amended by inserting after the word " secretary ", where appearing in subparagraph (a) of the third paragraph, the words " or by a person or persons thereunto authorised by the Minister on the recommendation of the Auditor-General ".
