ACTS AMENDMENT ACT OF 1932, [ASSENTED TO 15TH DECEMBER, 1932.J . B E it enacted by the King's l\1:ost Excellent Majesty, by and with tIle advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title and con· struction. 1. This Act may be cited as " The Hospitals Acts Amendment Act of 1932," and shall be read as one with *" The Hospitals Acts, 1923 to 1929," herein referred to as the Principal Act. The Principal Act and this Act may collectively be cited aR " The Hospitals Acts, 1923 to 1932." Amendments of the Principal Act. Amendment 2. The definition of "Contributors' payments , ~ in of B. 2. section two of the Principal Act is repealed. Amendment 3. Section four of the Principal Act is amended as of s. 4. follows :- Provisions (b), (c), and (d) of the first paragraph of the said section are repealed, and the following provisions (b), (c), (d), (e), and (f) are inserted in lieu thereof, namely:- Reconstitu· tion of Districts. . "(b) Reconstitute the Brisbane and South Coast Hospitals District or any District by the inclusion therein of any contiguous Area or Areas or part or parts of any contiguous Area or Areas; (c) Unite two or more Districts; (d) Abolish a District and include it in another District; (e) Alter any District by including in it part of another District and excluding the said part from the latter District; (f) Apply this Act to any hospital within a District." * 14 Geo. Section twelve of the Principal Act is amended Amendment as f 0 11oWS: - of s. 12. (a) The words "of twenty pounds" occurring in paragraph (e) of the proviso of subsection two are repealed, and the words " of one hundred pounds" are inserted in lieu thereof. (b) Subsection three is amended by the addition thereto of the following paragraph, namely :-- " Any such failure on the part of any member to J:?isqualifica- attend three consecutive meetings of the Board extending : ~ ~ ~ : rs. over the said period shall be reported to the Board by the secretary at its next meeting." 6. A new section 14A is inserted after section New s. 14A. fourteen of the Principal Act as follows:- " [14A.] The first meeting of the Board after its First. first constitution, and thereafter the first meeting after ~ ~ : ; ~ ~ g of the election and appointment of the Board, shall be convened by the returning officer as soon as may be after the constitution of the Board." 7. No. 26, management, and control of every hospital within the District to which this Act has been applied and every hospital which may hereafter be established by the Board within its District. (2.) The Board, with the approval of the Governor in Council, may from time to time- (a) Establish in any part of the District new hospitals; (b) Amalgamate any two or more hospitals in its District; (c) Close any hospital in its District." oRAfemsv. een 2 nd 1 u . me.ent amen 8 d . edSeacstiofnolltowwens: ty- -one of the Principal Act is Paragraph (a) of subsection two is repealed and the following paragraph (a) is inserted in lieu thereof : - "(a) All grants, contributions, donations, patients' payments, or other payments received by the Board under or pursuant to this Act ; , , ~ also paragraph (d) of the said subsection is repealed. The following proviso is added to the said sub- section, namely :- "Provided always that bequests, legacies, and all moneys arising from any gift or devise of real property received by or vested in the Board under and pursuant to this Act shall be paid into a Special Fund, and shall be applied by the Board as hereinafter directed." Amendment 9. Section twenty-two of the Principal Act is of s. 22. amended by inserting before the words "from time to time" the words "with the approval of the Minister." New ss. 23A 10. The following new sections 23A and 23B are and 23B. inserted after section twenty-three of the Principal Act as follows :- Separate " [23A.] The Board shall cause a separate and a1ccount of distinct account to be kept of all loan moneys received oan moneys. b Y ' It, an d a 11 moneys formm . g part 0 f any suc h 1 oan s h a 11 be paid into a separate account in the bank, which shall be called the " [name of District] Hospitals Board Loan Fund Account." Such money shall be applied solely to the purposes for which the money was borrowed.

If, after all the works or purposes for which such moneys were borrowed are completed or. effected, there is any surplus of any loan advanced by the Treasurer, the Board shall repay the same to the Treasurer in part liquidation of the loan. The Minister may require the secretary of the Board or other officer to whom the duty of compiling such information is delegated to furnish a statutory declaration that the contents of such statements are true and correct in every particular. Any such officer furnishing false information shall be guilty of an offence against this Act." 11. Section twenty-four of the Principal Act is Repeal of repea1ed and the f 0 11 oW . As soon as may be after the constitution Bo~rd shall of the Board, and thereafter in every year before the f~ ~~' ::~ nd fourteenth day of July, the Board shall estimate as expenditure. accurately as possible, and in such form as the Minister may require- (a) The total amount of the expenditure required for the current year ending on the thirtieth day of June following for- (i.) Administration of the Hospital Board; (ii.) Maintenance of each hospital of the Hospitals Board dealt with separately; (iii.) Annual charges for interest and redemption or payments to sinking fund of moneys borrowed by the Board; and (b) The total amount of the probable income of the Board during the same period other than contributions from the Government and the component Local Authorities pursuant to section 24A of this Act.

Every such estimate shall be subject to the approval of the Governor in Council, and until so approved shall have no force or effect." New ss. 24A 12. The following new sections 24A and 24B are and 24B. inserted after section twenty-four of the Principal Act as follows :- Contribution " [24A.] The difference between the estimated mofeGntovaenrdn· expenditure and the estimated income of the Board Local shall be known as the amount to be contributed and shall Authority. be paid- (a) By the Treasurer who shall, out of moneys to be appropriated from time to time by Parliament for the purpose, pay to the Board an amount equal to sixty per centum of such difference; and a receipt signed by the chairman or secretary shall be a sufficient discharge to the Treasurer for such payment; (b) By the component Local Authorities who shall pay to the Board an amount equal to forty per centum of such difference. Deficit or [24B.] If in any year the amount received by the ~ ~ rf! ~~~ o Board from all sources falls short of the actual expenditure into account for the year, then the resulting deficit shall be added to iyneafor.llowing the estimated expenditure for the ensuing year. If the amount received by the Board from all sources exceeds the actual expenditure for the year, then the resulting surplus shall be deducted from the estimated expenditure for the ensuing year." Repeal of 13. Hospitals Acts Amendment Act. bazaars, carnivals, concerts, dances, sports meetings, race meetings, competitions, or other form of entertain- ment to which the public have subscribed, or the sale of tickets in raffles, art unions, lotteries, consultations, or any similar devices, or contributions by any employee or association of employees, whether made by way of deduction from wages or by direct payment by such employee, or by any person or group of persons or bodies whereby the contributor is assured the right of free treatment or the right to treatment at a reduced rate of payment or any benefits at the hospital for himself and/or his wife and family, except where such hospital is established under *" The Hospitals Acts, 1847 to 1891," and a Committee duly formed and constituted under such Acts, or except w.here such hospital shall be established by a Board under this Act. And it shall not be lawful for any person or any association of persons, or any other body other than a Committee formed and constituted pursuant to *" The Hospitals Acts, 1847 to 1891," or a~ Board constituted pursuant to this Act, to solicit or to accept from the public any moneys, gifts, or contributions as hereinbefore described for the establishment or maintenance of any hospital: Provided that a " Hospital Committee" within the meaning of *" The Hospitals Acts, 1847 to 1891," or a " Board" within the meaning of this Act, may by resolution authorise any person or association of persons to collect or receive moneys, gifts, or contributions on its behalf for the general purposes of the hospital or for some specific purpose of the hospital. In such case the Hospital Committee or Board, as the case may be, shall, in writing" under the hand of the president or chairman, specify the name or names of the persons or associations so authorised, the amounts which they are authorised to collect, the District or Districts in which such collections may be made, and the period during which such persons or associations are authorised to collect or receive moneys, gifts, or contributions on behalf of the hospital. (2.) Any member of a Hospital Committee as aforesaid or of a Board, or any authorised officer of a Hospital Committee or Board, or any member of the * 11 Vie. Police Force may demand from any person or association or any other body collecting or receiving moneys, gifts, or contributions as hereinbefore described from the public the production of his or their authority to collect or receive such moneys, gifts, or contributions of any kind, and in the event of refusal or failure to do so may institute proceedings against such person or association or other body. (3.) Any person committing a breach of the provisions of this section shall, in the· case of a person, be liable to a penalty not exceeding twenty pounds or, in the case of a corporation or company, to a penalty not exceeding one hundred pounds: Provided that nothing in this section shall be deemed to extend or to apply to any hospital established or to be established under the provisions of *"The Friendly Societies Acts, 1913 to 1926," or to any hospital established or to be established by any religious organisa- tion, or by any organisation or institution excepted from the operation of this section by the Governor in Council by Order in Council, or to any person or association of persons acting with the knowledge, consent, and authority of the controlling authorities of any such hospital. The term "hospital" as referred to in subsection one of section eighty-five of to. The Industrial Oonciliation and Arbitration Acts, 1929 to 1931," shall mean and include a hospital established under t" The Hospitals Acts, 1847 to 1891" (with a Committee duly formed and constituted under such Acts), or a hospital established pursuant to §" The Hospitals Acts, 1923 to 1932," or a hospital established under *" The Friendly Societies Acts, 1913 to 1926," or a hospital established by any religious organisation, and shall not mean and include any other hospital however established." * 4 Geo. HOSPITALS-INCOME TAX. 23 GEO. V. No. 29, 1932. Income Tax Acts Amendment Act. 1415a 14. Part I. of the Schedule to the Principal Act Amendment IS amended as follows:- of Schedule. (a) Clause four is repealed and the following new clause is inserted in lieu thereof, namely : - " [4.] In order that a person may be or become a candidate for election he shall- (a) In the case of the members to be elected by the Local Authorities be a member of one of the component Local Authorities and be nominated by not less than two members thereof who are entitled to vote; (b) In the case of the members to be elected by the contributors, be nominated by not less than two contributors entitled to vote." (b) Clause eleven is amended by the inclusion therein of the following new paragraph, namely:- "In case of accident or omission the Governor in Council may appoint some fit and proper person to act as Returning Officer."
