1 Name of plan
This plan is Hornsby Shire Local Environmental Plan 1994
(Amendment No 90).
2 Aims of plan
This plan aims to permit, with the consent of Hornsby Shire Council, the carrying out of development of the land to which this plan applies for the purpose of plant and equipment hire premises on land within the Business A (General) Zone, the Business B (Special) Zone, the Business E (Service Centre) Zone, the Business F (Town Centre) Zone, the Business G (Town Centre Support) Zone, the Industrial A (General) Zone and the Industrial B (Light) Zone under Hornsby Shire Local Environmental Plan 1994.
3 Land to which plan applies
This plan applies to all land within the local government area of
Hornsby.
4 Amendment of Hornsby Shire Local Environmental Plan 1994
Hornsby Shire Local Environmental Plan 1994 is amended as set out in
Schedule 1.

[1] Clause 7 Zoning control table
Insert “plant and equipment hire premises;” before “public buildings;” wherever occurring under the heading “Only With Development Consent” in the matter relating to the Business A (General) Zone, the Business B (Special) Zone, the Business E (Service Centre) Zone, the Business G (Town Centre Support) Zone, the Industrial A (General) Zone and the Industrial B (Light) Zone in the table to the clause.

Insert “plant and equipment hire premises;” before “public buildings;” under the heading “Only With Development Consent” where firstly occurring in the matter relating to the Business F (Town Centre) Zone.

Omit the heading “Only With Development Consent” where secondly occurring in the matter relating to the Business F (Town Centre) Zone.
Insert instead “Prohibited”.
[4] Clause 23 Dictionary
Insert in alphabetical order in clause 23 (1):
plant and equipment hire premises means a building or place where plant, machinery, tools and equipment are stored and displayed and are available for hire or lease to persons for temporary use, and for the repair, service and maintenance of such items, but does not include a building or place used for one or more of the following purposes:
| (a) | home entertainment equipment, such as stereo sound systems, televisions, audio visual equipment and the like, |
| (b) | party and function equipment, such as catering equipment, music players, tables, seating and the like, |
| (c) | motor showrooms. |
