[ASSENTED TO 14TH DECEMBER, 1944.] W HEREAS the Honourable John Dash was aPreamble. Member of the Legislativ~ Assembly of Queens- land from the ninth day of October, one thousand nine hundred and twenty, to the fourteenth day of April, one thousand nine hundred and forty-four, and was a member of the Executive Council, holding office as Minister for Transport from the seventeenth day of June, one thousand nine hundred and thirty-two, to the fourth day of August, one thousand nine hundred and thirty-nine: And whereas, while Minister for Transport, the said the Honourable John Dash sustained, while travelling in the course of his duties, serious injuries in a railway accident at Yandina during the month of September, one thousand nine hundred and thirty-two: And whereas as the result of such accident the said the Honourable John Dash never regained his usual health, causing him eventually to tender his resignation as Minister for Transport and member of the Executive Council on the date previously indicated: And whereas the Governor in Council, in the circum- stances, has approved of the payment of a gratuity of an amount of one thousand five hundred pounds to the Honourable John Dash, subject to Parliamentary ratification; which amount shall be and be deemed to be in full settlement of any action or claim which the said the Honourable John Dash may have, or might have had against the Commissioner for Railways, or the Government of Queensland in respect of the said accident.
428 PENSIONS AND GRATUITIES. Honourable John Dash Gratuity Act. 9 GEO. VI. No. 5, 1944. Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- Short title. 1. This Act may be cited as "The Honourable John Dash Gratuity Act of 1944." Gratuity to 2. (1.) There shall be payable out of the Consoli- tHhoenourable dated Revenue Fund (which is hereby appropriated John Dash. accordingly) by way of gratuity to the said the Honourable John Dash, a sum of one thousand five hundred pounds. Indemnity. (2.) And it is hereby declared that the said sum shall be and be deemed to be in full settlement of any action or claim which the said the Honourable John Dash may have or might have had against the Com- missioner for Railways, or the Government of Queensland in respect of the accident to him (as referred to in the Preamble); and the Commissioner for Railways and the Government of Queensland are hereby indemnified against any such action or claim, and any liabilities in respect thereof accordingly. Date of 3. The above payment shall be made to the said payment. the Honourable John Dash on the passing of this Act.
