The applicant seeks special leave to appeal from a judgment of the Court of Appeal of the New South Wales Supreme Court (Basten AJA; Macfarlan JA and Simpson AJA agreeing) dismissing an appeal against a decision of the Supreme Court of New South Wales (Black J).
There is no reason to doubt the Court of Appeal's decision and its analysis regarding the principles of contractual repudiation. The proposed grounds of appeal therefore do not enjoy sufficient prospects of success to warrant a grant of special leave to appeal.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
