AN ACT to amend the Honey Pool Aet, 1978.

[Assented to 3rd October, 1979.1

RE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Honey Pool Snort title

Act Amendment Act, 1979. citation.

(2) In this Act the Honey Pool Act, 1978 is referred r19113 . "

to as the principal Act.

(3) The principal Act as amended by this Act may

be cited as the Honey Pool Act, 1978-1979.

Commence -

ment. 2. This Act shall come into operation on the day

that the Honey Pool Act, 1978 comes into operation.

Section 4

amended. 3. Section 4 of the principal Act is amended by

deleting the interpretation "prescribed participant"

and substituting the following interpretation

"prescribed participant" in relation to an election under this Act means a participant who, in the twelve months ending on the thirtieth day of June immediately preceding that election, has delivered to the Honey Pool, whether constituted under the Honey Pool Act, 1955-1970, or under this Act, an amount of honey that is not less than such amount as is prescribed; .

Section 8

amended. 4. Section 8 of the principal Act is amended

(a) by adding after subsection (2) the following subsection

(2a) The person appointed to be member pursuant to paragraph (a) of subsection (2) shall be Chairman of the Board. ; and

(b) as to subsection (8), by deleting the words "ceases to be a prescribed participant" in the last line and substituting the passage "does not in a period of twelve months ending on the thirtieth day of June during the term of his office as Director deliver to the Honey Pool an amount of honey that is equivalent to or greater than the amount prescribed for the purposes of the definition "prescribed participant" in section 4".

Section 29

amended. 5. Subsection (2) of section 29 of the principal

Act is amended

(a) by deleting paragraph (b);

(b) by adding after the word "elections" in the last line of paragraph (c) the words "and providing for those entitlements to be related to quantities of honey accepted by the Honey Pool"; and

(c) by deleting paragraph (d).

6. The principal Act is amended by adding after Mteig13°

section 29 the following section-

30. (1) Notwithstanding the provisions of TranSitthnal•

section 8 the constitution of the Board, and the appointment, and terms of office, of Directors shall, until the appointed day fixed under subsection (2), be in accordance with the provisions of the Honey Pool Act, 1955-1970.

Subject to subsection (3) the Minister

may by notice fix a day as the appointed day

for the purposes of subsection (1).

(3) The notice referred to in subsection (2) shall be published in the Government Gazette not less than three months before the day specified therein as the appointed day.

(4) Nothing in subsection (1) prevents the doing, before the day appointed pursuant to subsection (2), of anything that is necessary to be done for the purposes of constituting the Board pursuant to section 8. .
