The Authority's decision was based too heavily on the past findings without adequately assessing the applicant's present circumstances and her efforts towards rehabilitation. The Court applied the principle that a determination of fitness and propriety requires a contemporary assessment, taking into account all relevant factors, including the applicant's past conduct, the time elapsed since that conduct, and any evidence of rehabilitation.
The Court set aside the Authority's decision and remitted the matter to the Authority for reconsideration according to law.
