Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Home Building Act 1989.

Explanatory note
The object of this Regulation is to extend the period during which a contract of insurance for residential building work is exempt from an insurance requirement under the Home Building Act 1989. Under that Act, a contract of insurance in relation to residential building work at a stated address is taken to extend to any residential building work done at that address by a contractor (whether or not the contractor is named in the contract of insurance). This Regulation extends the exemption from that requirement to 31 December 2012.

This Regulation is made under the Home Building Act 1989, including section 140 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Home Building Amendment (Temporary
Exemption) Regulation 2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Home Building Regulation 2004

Clause 73 Temporary exemption from section 92B requirements

Omit “31 December 2011” wherever occurring in clause 73 (1).
Insert instead “31 December 2012”.
