His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Home Building Act 1989.

Explanatory note

The objects of this Regulation are as follows:

(a) to remove a provision relating to the Bonnyrigg Living Communities housing project that is no longer necessary following changes to the administration of the project,
(b) to update the requirements for warning signs at premises affected by loose-fill asbestos insulation,
(c) to update references to Australian and New Zealand Standards relating to specialist work authorised by contractor licences or certificates.

This Regulation is made under the Home Building Act 1989, including sections 119B (2) and 140 (the general regulation making power).

1      Name of Regulation

This Regulation is the Home Building Amendment (Miscellaneous) Regulation 2019.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

[1]      Clause 64 Exemptions relating to Bonnyrigg Living Communities Project

Omit the clause.

[2]      Clause 68A Verification of presence of loose-fill asbestos insulation

Omit clause 68A (1) (b). Insert instead:

(b) a NATA-accredited laboratory, which is accredited for the relevant test method, has confirmed that a sample of material removed from the premises in the course of the investigation is or contains loose-fill asbestos.

Omit clause 68C (2) (c).

[4]      Schedule 4 Extended descriptions of work authorised by contractor licences or certificates
