Home Building Amendment (Insurance New South Wales

Exemptions) Regulation 2001

under the

Home Building Act 1989

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Home Building Act 1989.

Explanatory note
The object of this Regulation is to prescribe the following as classes of persons entitled to apply to the Director-General of the Department of Fair Trading to be exempted from certain insurance requirements under the Home Building Act 1989:

(a)

contractors doing residential building work on behalf of developers in connection with retirement villages or accommodation specially designed for persons with disabilities,

(b)

contractors doing residential building work that is funded by State or Commonwealth government departments or agencies.

This Regulation is made under the Home Building Act 1989, including sections

97 (1A) and 140 (the general regulation-making power).

1     Name of Regulation

This Regulation is the Home Building Amendment (Insurance
Exemptions) Regulation 2001.

2 Amendment of Home Building Regulation 1997

The Home Building Regulation 1997 is amended as set out in

Schedule 1.

The explanatory note does not form part of this Regulation.

Insert after clause 57A:

57B Persons entitled to apply for exemptions from insurance

requirements

For the purposes of section 97 (1A) of the Act, the following classes of persons are prescribed as entitled to apply (in relation to the work concerned) for the exemption referred to in that provision:

(a) contractors doing residential building work on behalf of developers in the circumstances set out in section 3A (2) (b) of the Act,
(b) contractors doing residential building work that is funded (whether wholly or partly) by departments or agencies of the New South Wales or Commonwealth government.

Note. The circumstances set out in section 3A (2) (b) of the Act concern residential building work done in connection with retirement villages or accommodation specially designed for persons with disabilities.
