His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Home Building Act 1989.

Explanatory note

The Home Building Act 1989 makes provision concerning the residential building industry and certain specialist work, including electrical work that was previously regulated under the Electricity Act 1945 (now the Electricity Safety Act 1945). Clause 10 (2) of Schedule 4 to the Home Building Act 1989 provides that certain certificates and licences in force under the Electricity Act 1945 immediately before the commencement of the Home Building Act 1989 are taken to be licences or certificates under the Home Building Act 1989.

The object of this Regulation is to provide that no fee is payable if a person who held an electrical mechanic's licence under the Electricity Safety Act 1945 authorising the person to do electrical work without supervision applies for a supervisor certificate to do electrical work under the Home Building Act 1989 (because the person has allowed his or her "deemed" licence under the Home Building Act 1989 to lapse).

This Regulation is made under section 140 of the Home Building Act 1989 and in particular section 140 (2) (j), the power to make regulations for or with respect to fees payable under that Act.

Insert after clause 34 (2) (c):

(c1)

for the grant of a supervisor certificate to do electrical work to a person who held an electrical mechanic's licence under the Electricity Act 1945, authorising the person to do electrical work without supervision, immediately before 21 March 1990 (the date of commencement of clause 10 of Schedule 4 to the Home Building Act 1989), or
